Your Auto Insurance Policy May Be Changing
In Pennsylvania, automobile insurance companies will no longer be required to submit disputes concerning payment of benefits under your Underinsured Motorist coverage (UIM) or Uninsured Motorist coverage (UM) to arbitration for resolution. The court recently ruled that auto insurers will no longer be required to include arbitration clauses in their policies, and can instead require you to sue your own insurance carrier in court in order to get your UIM or UM benefits. Arbitration has traditionally provided a lower cost, quicker method of resolving disputes and getting the UIM or UM benefits which you pay for with your premiums.
We anticipate that many insurance companies will be notifying you of changes to your policy, taking out or changing the arbitration clause. We think that these changes will make it harder for you to get your benefits.
